Quebec’s Implementation of Municipal Curbside Recycling Program

Following the model established in Ontario (see EIATRACK Regulatory Alert posted January 29, 2004 on Ontario’s Blue Box Program), Quebec recently began implementation of its regulatory regime requiring brand owners or first suppliers of consumer goods to pay weight-based packaging and printed material fees to cover 50% of annual total net costs incurred by municipalities for curbside recycling (the “Compensation Program”). The Fee Schedule for 2005 and 2006, which entered into force earlier this year, provides the reporting and fee contribution requirements for brand owners and first suppliers for municipal costs incurred during 2004 and 2005. Negotiations for the 2007 Fee Schedule, which will cover 50% of the net costs incurred by municipalities in 2006, will take place later this Fall.
