Introduction

China's waste classification system is particularly complex and confusing. Contributing to this confusion are the following:

  • an uncoordinated approach between hazardous waste systems for domestic, import, and export management;
  • a tendency for government authorities to interpret hazardous waste provisions but not uniformly or publicly communicate these interpretations or changes in interpretations;
  • a tendency for government authorities to assume electronic waste is hazardous waste when classification decisions are undertaken, and when such assumptions are not successfully challenged;
  • great government sensitivity to any issues associated with waste, particularly hazardous waste, contributing to conservative rulemaking and interpretation and preference to leave laws ambiguous (providing more opportunity for the government to make ad hoc/case-by-case decisions);
  • high likelihood that waste classification decisions of governments outside of China or multilateral institutions will influence China classification decisions.
