Update on Implementation of California’s Electronic Waste Recycling Act of 2003

On September 25, 2003, California’s former Governor Gray Davis signed the Electronic Waste Recycling Act of 2003 (the “Act”) (Senate Bill 20 (Sher-D, Palo Alto)). The law creates a new manufacturer and consumer responsibility regime for certain end-of-life electronics in California. This special report provides an update on the status of California’s implementation of this important new law, including the newly introduced clean up legislation, Senate Bill 50 (Sher-D, Palo Alto) (“SB 50”), and the impact of recently elected Governor Schwarzenegger’s Executive Order suspending state agency rulemaking activity.
