In 1987, Canada signed the Montreal Protocol on Substances that Deplete the Ozone Layer (the "Montreal Protocol"), a multilateral environmental agreement that established a schedule to reduce the production and importation of ozone-depleting substances ("ODSs"). Methyl bromide is listed in Montreal Protocol Annex E as a controlled substance, and has been banned under the Montreal Protocol since January 1, 2005, following a series of reductions. However, the Montreal Protocol provides for an alternative scheme under which parties that deem certain uses of methyl bromide to be critical may continue to produce up to 80% of their average annual production from the period of 1995 to 1998. For countries that choose the latter option, the methyl bromide ban under the agreement takes effect on January 1, 2015.

Canada has adopted regulations to meet its Montreal Protocol commitments. Under the Canadian Environmental Protection Act, 1999, Environment Canada administers the Ozone-depleting Substances Regulations. These regulations control the import, manufacture, use, sale and export of ODSs.
