The United Kingdom transposed the new EU Battery Directive (Directive 2006/66) through two sets of regulations:

  • The Batteries and Accumulators (Placing on the Market) Regulations 2008, Statutory Instrument No. 2164/2008 (the "Battery Regulations"). The Battery Regulations entered into force on the 26 September 2008; and
  • The Waste Batteries and Accumulators Regulations 2009, Statutory Instrument No. 890/2009 (the "Battery Producers Regulations").

The Battery Regulations are aimed at maximizing the separate collection and recycling of spent batteries and accumulators, and reducing the disposal of batteries and accumulators in the municipal waste stream. They apply to all batteries and accumulators placed on the market, regardless of their shape, volume, weight, material composition or use; and all appliances into which a battery is or may be incorporated.

The Battery Regulations partially implement the EU Battery Directive 2006/66/EC. The following provisions of the Directive are transposed through these regulations: Articles 4, 6(2), 11 and 21(1), (3), (4), (5), and (6).

In April 2009, the United Kingdom adopted a second set of Regulations, the Battery Producers Regulations 2009, which entered into force on 5 May 2009. These regulations impose obligations on producers and importers of batteries to register and keep records and to subscribe to a recycling compliance scheme.
