This report provides an overview of legislation of Hungary that imposes obligations with respect to packaging of electrical and electronic equipment and other products.

In 1994, the EU adopted the Packaging and Packaging Waste Directive 94/62/EEC (the "Directive"), which partly harmonizes Member States' national packaging legislation. The Directive imposes design, take-back and information requirements on packaging.

Hungary transposed the Directive through the Regulation 442/2012 (XII. 29.) on packaging and waste management activities relating to packaging waste, and packaging waste management that came into force on 1 April 2015 (the "Packaging Act"), the Act CLXXXVI of 2012 on waste and Regulation LXXXV 343/2011 of 2011 on the environmental protection product fee. This transposition appears to be consistent with the Directive and is subject, together with all its implementing regulations, to ongoing changes at the moment. This because the Ministry of Rural Development and the practical renewal of the Hungarian waste packaging system is currently under review.

This report provides an overview of the national provisions that differ from or complement the Directive, including where the Directive leaves discretion to the Member States. Note that additional chemical restrictions may also be imposed on packaging by the REACH Regulation, the POP Regulation, and other chemical regulations.
