Most asbestos containing products were banned by the U.S. Environmental Protection Agency (“EPA”) in 1989, acting under authority of the Toxic Substances Control Act (“TSCA”). However, in 1991 the U.S. Fifth Circuit Court of Appeals invalidated EPA’s ban on asbestos, holding that EPA failed to comply with TSCA’s substantive and procedural mandates in several important respects. As a result of the Court's decision, only the following specific asbestos-containing products remain banned: flooring felt, rollboard, and corrugated, commercial, or specialty paper. The regulation also continues to ban the use of asbestos in products that have not historically contained asbestos, otherwise referred to as "new uses" of asbestos.

In addition, the U.S. Consumer Product Safety Commission has developed bans on the use of asbestos in textured paint, wall patching compounds, general-use garments and artificial ashes and embers used in fireplaces. See 16 C.F.R. 1500.17, 1304 & 1305.
